Questioned by board, state health law deemed unconstitutional by judge

WILLIAMSVILLE, NY (July 11, 2022) – State Supreme Court Judge Ronald Ploetz, of Cattaraugus County, on July 8 ruled that the state Department of Health exceeded its authority when it introduced the Isolation and Quarantine Procedures regulation earlier this year. 

In May, the Village Board voted 3-2 to send state representatives a resolution that expressed the majority’s opposition to the DOH regulation, which can be viewed here.

The regulation was deemed unconstitutional as Judge Ploetz said it was a violation of separation of powers.
